They do indeed hold trademark on that particular shade of brown.

Of course, this doesn't mean that no other company or person can use that shade! It merely means that no other parcel delivery company may use that shade.

UPSs are meant to prevent brown-outs, so you're violating one trademark and protecting the other. Maybe the two cancel each other out.

UPS is not a single case. The german telekom claimes the right to exclusively use magenta =a pinkish red for commercial appearance. They alread took juristical steps versus companies which used that color too.

As I just noticed recently the phrase "regular,everyday light" is a registered trademark of General Electric.
This is stated on the packaging for their incandescent bulbs.

Personally I think that trademarks are being overused to the point of pointlessness. An overabundance of trademarks for simple and common terms (many of which are probably too simple and common to have qualified for a trademark in a sane world, anyway) may eventually lead to the concept of trademarks in general being devalued so that no one takes them seriously, including the courts.
