Let's suppose someone listed a genuine first design of an Intel processor - ie a Intel book - a bound book that was for internal use at Intel.

Let's suppose they listed it on eBay and it caused frantic bidding and sold for $1,200.

If a month later the original lister decides to sell a photocopy of the item under the guise of 'They were able to get a photocopy from the previous owner'.

Note the fact they say 'a' copy - like there is only one copy.

Yet again, frantic bidding - it sells for $550 - because some people think they are lucky to get a second chance to bid on the item (even though this is a copy).

What if a month later the lister re-lists the item again under the guise of 'They were able to get a photocopy from the previous owner'.

If that copy sells for $150, does the winner of the copy that sold for $550 have a justifiable grievance?

What are your thoughts here - is it tough luck - or is the lister clearly trying it on?

I forgot to mention - what if a bidder on the first listing of the copy (the photocopy that sold for $550) requested the lister to relist the item?

That's the point I forgot to make clear.

Both. The seller is trying it on, and you have no grievance because he never explicitly said it was a one of a kind. Besides, even if he *did* say it was a one of a kind, you'd never be able to prove he knew it was untrue.

If EBay won't do anything about people openly selling counterfeits and claiming them to be genuine, to the point where they actually put account restrictions on people who report counterfeit items, what do you think they're gonna do about someone who's just being a bit sneaky?

And yes I'd say the lister is pushing it, but it's on eBay - what do you expect? Just leave him negative feedback, and start flooding eBay with your own "copy from a previous owner".

I don't like eBay.

Things for internal use are generally illegal to sell, trade secrets, and Intel could come down VERY heavily on the person selling it. Of course Intel may have released this to the public if it is old enough.

Selling a photocopy of a book is generally against the law (here in the US anyway). Books are copyrighted material and making a photocopy for personal use is OK, making a photocopy and selling it is breaking the law.

As for the not liking eBay puki, just about a month ago, you were in eBay heaven. :) I think it is like that for many people. When they first start using eBay, the idea of it seems great. Once you get used to it, you find that eBay is a joke. I quit using eBay when they combined with PayPal, PayPal is a huge rip-off. It is fine and dandy until they decide you did something they don't like, then it is very possible that they will grab your cash and you will never see it again.
