Well, it is very naughty if it is true.
I thieve as much media as I can get - however, I've never distributed my stuff - let alone sell it.
It is possible that during development they *borrowed* media from other games as placeholders and lost track of what was what. It is a possible scenario. I'd assume there is not too much of this media and not too much fuss is going to be raised.
