I've bought a few games on Steam and am happy with most of them.

Today I downloaded Advent and I find that it crashes a fair bit so looked into Steams refund policy, basically it is this...

Although I obviousy agreed to the terms and conditions am I right in thinking that my statutary rights are being overlooked and in addition the distance selling regulations...or do these not apply since the company is based in the US?

The laws should apply to where you personally are. there's normally a line basically saying some of the terms outlined may not be applicable where you are.

Mmm, isn't the problem here the fact that we are buying direct. Maybe it is because you have nothing to take back for them to resell.

If you buy a computer game from a store then, normally, you can take it back and swap it or at least get vouchers for it.

The problem here is the game may not be faulty - it may be crashing on your system (and other people's) but working fine on others.

I'd rest assure that the game will be patched, like most games, in the coming weeks.

Or if you are generally not happy, look into your options.

I gave what I thought above, but its always best to check.

Check that your system meets the minimum requirements for the game.

If it does, you have a case. If not, you're stuffed.

How do you define faulty? If it doesn't work - it's faulty.

I wouldn't agree with that. If it doesn't work, it doesn't mean it is faulty. The game may not be at fault at all - however, it might be.

Doesn't matter what their EULA says...Steam doesn't make the laws. My guess is you will see a few class-actions against them soon.

The thing that pisses me off is that Steam is supposed to cut out the middleman, yet there is no savings whatsoever to the customers. Even if Valve got 80% of their publishing costs back, they could give us a little discount. My guess is they have a contract not to undersell the stores, so as long as Steam games are still on store shelves, we won't get a discount.

Steam just concider themselves to be a "Postal Service", that it as long as the goods are delivered in the same condition as sent, then it isnt their problem.

Now we can sit here and moan about how wrong this is, and as Lead has said there will be some future court cases to clarify the situation.

At the moment however, they are "Within the Law", to say its not their fault. (I would say it should be their responsibility :- But they can still say its not). When it comes down to it, it is steams responsibility to tell you who you can get a refund from.
